1. Introduction

Welcome to Kshels Party Supplies. We provide party rental equipment and related services for weddings, birthdays, baby showers, corporate events, and other special celebrations in New Jersey.

These Terms and Conditions explain our policies regarding reservations, payments, cancellations, deliveries, equipment use, customer responsibilities, damages, and safety. By booking rental equipment or services with Kshels Party Supplies, customers acknowledge and agree to these Terms and Conditions.

We encourage all customers to review these policies carefully before completing a reservation.

2. Reservations and Booking

2.1 Booking Confirmation

A reservation is confirmed only after Kshels Party Supplies receives the required deposit or payment and provides booking confirmation to the customer. Submitting an inquiry, requesting a quote, or selecting rental items does not automatically guarantee a reservation.

2.2 Equipment Availability

All reservations are subject to equipment availability. Kshels Party Supplies will confirm the availability of requested rental items during the booking process.

2.3 Customer Information

Customers must provide accurate and complete event information, including:

• Event date
• Delivery address
• Requested delivery time
• Rental period

Customers are responsible for ensuring that all information submitted during booking is correct. Accurate information helps Kshels Party Supplies prepare equipment and coordinate delivery, setup, and pickup services.

3. Payment Terms

3.1 Reservation Deposit

A security deposit equal to 50% is required to secure a reservation. A reservation is confirmed after the required payment has been received and booking confirmation has been provided.

3.2 Remaining Balance

Customers must pay the remaining balance no later than five (5) days before the scheduled event. Payment may also be made upon delivery when both parties have agreed to this arrangement in writing. Customers must follow the payment schedule confirmed during the booking process.

3.3 Accepted Payment Methods

Kshels Party Supplies accepts the following payment methods:

• Credit Card
• Zelle
• Cash App

3.4 Additional Charges

Additional fees may apply when customers request services beyond their original reservation or when circumstances require additional work. These charges may include:

• Extended rental periods
• Additional services
• Late equipment returns
• Additional delivery requirements
• Other services requested by the customer

Applicable charges will depend on the services provided and the agreed rental terms.

3.5 Unpaid Balances

Kshels Party Supplies may withhold the release, delivery, or installation of rental equipment when the required payment has not been received. This policy applies subject to applicable law and the agreed payment terms.

4. Cancellations and Refunds

Kshels Party Supplies understands that event plans may change. We handle cancellation requests according to the cancellation policy disclosed during booking and applicable law.

4.1 Cancellation Requests

Customers must submit all cancellation requests in writing. Written requests help maintain accurate records and allow both parties to review the cancellation arrangements.

4.2 Deposit Refunds

Deposits may be refundable or nonrefundable depending on the cancellation policy disclosed at the time of booking and applicable law. Customers should review the refund terms before confirming their reservation.

4.3 Cancellations 10 Days or More Before the Event

Customers who cancel ten (10) days or more before their scheduled event may qualify for a refund or credit. Refund or credit eligibility will depend on the cancellation terms disclosed at booking.

4.4 Cancellations Less Than 10 Days Before the Event

Cancellations made less than ten (10) days before the scheduled event may result in additional charges. Any applicable charges will follow the cancellation terms provided to the customer.

4.5 Cancellation by Kshels Party Supplies

If Kshels Party Supplies cancels a confirmed reservation because of equipment unavailability or circumstances within the company's control, the customer will receive either:

• A refund of the amounts paid for the affected rental; or
• Another arrangement mutually agreed upon by both parties.

5. Weather-Related Cancellations

Weather conditions may affect scheduled events, equipment delivery, setup, and pickup. Kshels Party Supplies will handle weather-related cancellations according to the weather policy agreed upon with the customer during booking. Any applicable refund, credit, or alternative arrangement will depend on the agreed weather policy.

6. Delivery, Setup, and Pickup

6.1 Access to the Event Location

Customers must provide safe, clear, and reasonable access to the delivery and setup location. The delivery area and designated setup space must be accessible and ready at the agreed time.

6.2 Delivery, Setup, and Pickup Fees

Kshels Party Supplies will disclose all applicable delivery, setup, and pickup fees before the booking is finalized.

6.3 Site Conditions and Hazards

Before equipment setup, customers must identify and report potential hazards at the event location, including:

• Underground utilities
• Sprinkler systems
• Septic systems
• Overhead obstructions
• Uneven ground
• Other conditions that may affect safe installation

Customers must provide accurate information about the event location to help ensure safe and proper equipment setup.

6.4 Delivery and Pickup Schedule

Delivery and pickup times are estimates. Scheduled times may change because of traffic, weather, or circumstances beyond the reasonable control of Kshels Party Supplies. Customers must ensure that the setup area is ready at the agreed time.

6.5 Additional Delivery or Pickup Charges

Additional fees may apply for:

• Inaccessible delivery locations
• Additional waiting time
• Stairs or difficult access points
• Excessive distances between the delivery vehicle and setup area
• Rescheduled delivery or pickup

These fees apply when disclosed in the rental agreement.

7. Customer Responsibilities

7.1 Responsibility for Rental Equipment

Customers are responsible for rental equipment from the time of delivery or transfer of possession until pickup or return is completed.

7.2 Proper Use of Equipment

Customers must use all rented equipment only for its intended purpose and follow any instructions provided by Kshels Party Supplies.

7.3 Equipment Restrictions

Customers may not take the following actions without written permission from Kshels Party Supplies:

• Move rental equipment
• Alter or modify equipment
• Attempt equipment repairs
• Sublease equipment
• Lend equipment to another person or business

7.4 Equipment Protection

Customers must take reasonable steps to keep rental equipment secure and protect it against:

• Theft
• Misuse
• Vandalism
• Preventable damage

7.5 Reporting Equipment Problems

Customers must promptly notify Kshels Party Supplies of any equipment damage, malfunction, or safety concern.

7.6 Equipment Return Condition

All rented equipment must be returned in the condition received, except for reasonable wear resulting from proper use.

8. Damage, Loss, and Missing Equipment

8.1 Customer Responsibility

Customers may be charged for rental equipment that is:

• Missing
• Stolen
• Damaged beyond ordinary wear and tear

8.2 Repair and Replacement Costs

Applicable charges may include:

• Reasonable equipment repair costs
• Replacement costs for missing or damaged items
• Documented additional expenses permitted by applicable law and the rental agreement

Charges will depend on the circumstances and the condition of the equipment.

8.3 Explanation of Charges

Kshels Party Supplies will provide an explanation of applicable damage, repair, or replacement charges upon customer request.

8.4 Equipment Inspection

Customers should inspect rental equipment upon delivery. Any existing damage, missing items, or concerns should be reported promptly to Kshels Party Supplies.

8.5 Damage Not Caused by the Customer

Customers are not responsible for damage caused by negligence on the part of Kshels Party Supplies or other circumstances for which the customer is not legally responsible.

9. Safety and Proper Use

9.1 Safe Equipment Use

All rental equipment must be used safely and according to manufacturer instructions and applicable laws.

9.2 Adult Supervision

Children must be supervised by a responsible adult whenever appropriate during the use of rental equipment.

9.3 Prohibited Equipment Use

Customers must not:

• Overload rental equipment
• Misuse equipment
• Operate equipment in unsafe conditions
• Use equipment for purposes other than those intended

9.4 Damaged or Unsafe Equipment

Customers must immediately stop using rental equipment if it becomes unstable, damaged, or unsafe. Customers must promptly report equipment problems or safety concerns to Kshels Party Supplies.

9.5 Unsafe Setup Conditions

Kshels Party Supplies may refuse or suspend equipment setup or use when conditions present a safety risk. This policy helps protect customers, event guests, and rental equipment.

10. Customer Acknowledgment and Agreement

By completing a reservation with Kshels Party Supplies, customers acknowledge that they have reviewed and agree to these Terms and Conditions. Customers understand and accept the policies regarding:

• Reservations and booking confirmation
• Equipment availability
• Deposits and payment requirements
• Additional service charges
• Cancellations and refunds
• Weather-related cancellations
• Delivery, setup, and pickup
• Customer responsibilities
• Equipment damage, loss, and replacement
• Safety and proper equipment use

Customers agree to follow the applicable policies throughout the rental period.
